Terms of Service

BubblyPhone Agents is a telephony API platform that enables developers to connect AI assistants to inbound and outbound phone calls. The Service provides:

• Provisioning and management of phone numbers.
• Inbound and outbound call routing via webhook and real-time streaming modes.
• Call recording, transcription metadata, and usage analytics.
• An API for programmatic control of all telephony functions.

You must be at least 18 years old and have the legal capacity to enter into a binding contract to use the Service. By using the Service, you represent that you meet these requirements.

You must provide accurate and complete information when registering. You are responsible for maintaining the confidentiality of your API keys and account credentials. You are responsible for all activity that occurs under your account.

The Service supports a BYOK model. You may supply credentials for supported third-party providers (telephony carriers, AI model providers). By supplying such credentials:

• You represent that you are authorised to use those credentials.
• You accept all costs charged by third-party providers directly.
• You remain responsible for compliance with those providers’ terms of service.

You agree not to use the Service to:

• Make unsolicited or unlawful automated calls (e.g. robocalling, telemarketing without consent).
• Violate any applicable telecommunications law, including the TCPA, UK Communications Act, or equivalent regulations.
• Facilitate fraud, harassment, threats, or illegal activity of any kind.
• Impersonate emergency services or any governmental authority.
• Reverse-engineer, resell, or sublicense the Service without our written consent.
• Interfere with or disrupt the integrity or performance of the Service.

We reserve the right to suspend or terminate your account immediately for any violation of this section.

The Service is billed on a pay-as-you-go basis. You will be charged for:

• Per-minute call usage (inbound and outbound).
• Phone number provisioning (monthly fee per number).
• Any add-on features as described on the pricing page.

Charges are calculated at the rates in effect at the time of use and are itemised in your usage dashboard. All prices are in US Dollars (USD). Payment is processed via Stripe. We reserve the right to suspend access to the Service for overdue balances.

Credits never expire. There are no time limits on your prepaid balance.

We reserve the right to change pricing at any time. We will provide at least 14 days’ notice of any price increase via email or dashboard notification. Continued use of the Service after a price change constitutes acceptance of the new pricing.

All intellectual property in the Service, including software, documentation, and trademarks, remains the exclusive property of Inhype Live Limited. These Terms do not grant you any ownership rights in the Service.

You retain ownership of any content, data, or AI assistants you connect to the Service.

Use of BubblyPhone through third-party AI assistants (ChatGPT, Claude, Cursor, etc.) is also subject to those platforms’ terms of service. We are not responsible for the behaviour, availability, or data handling of third-party platforms.

The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or meet your specific requirements.

To the maximum extent permitted by applicable law, in no event shall Inhype Live Limited be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. Our total aggregate liability to you for any claim arising out of or related to these Terms or the Service shall not exceed the greater of (a) the amount you paid to us in the 12 months preceding the claim, or (b) £100 GBP.

You agree to indemnify, defend, and hold harmless Inhype Live Limited and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:

• Your use of the Service in violation of these Terms.
• Your violation of any applicable law or regulation.
• Any content or AI assistant you deploy via the Service.
• Any claims brought by end users of applications you build on the Service.

• You may terminate your account at any time. Remaining credits are not refundable.
• We may suspend or terminate your account if you breach these Terms, if required by law, or after 12 months of inactivity.
• Upon termination for breach, all credits are forfeited.

Before filing any formal complaint, you must contact us at hello@bubblyphone.com. We will investigate within 48 hours.

These Terms are governed by the laws of England and Wales. Any disputes arising out of or related to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
